Intellectual Property Notice 

Rights to artwork remain the sole property of Briana Fitzpatrick including after purchase. This includes the purchase of originals, commissions, prints and current and/or future reproductions of any kind. The purchase of any item, original or otherwise, does not grant the customer permission to mint the piece into an NFT, print and distribute in any form or reproduce in any way by means of profit and/or otherwise.

Collectors may not reproduce artwork in any way without express written permission from the artist. Posting images of the items purchased on social media are always welcome and does not breach this clause.

Liability

I, Briana Fitzpatrick, am not liable for goods once they are in the possession of the collector. It is not my duty to refund, exchange, replace or compensate by any means for the damage of products that have been mishandled by customers. For example: smudging fingerprints on the white border, tearing fine art prints, damaging works, etc.

If an item is received damaged due to how the postal services and/or faulty merchandise has been dispatched the item, then please contact me and I’ll do my best to offer you the best solution. Every artwork, print, sticker, and product is inspected before clearing for shipment and only high quality purchased reproductions are packaged for you to enjoy.

Please read the product descriptions thoroughly and carefully. It is not my duty to compensate customers who do not read the information provided in the product description prior to purchase.

Returns, Replacements and Refunds

If there is an issue with your order, I won’t leave you hanging! If something has gone wrong, or your item wasn’t as you were expecting - I will do what I can to make it right. I do my best to offer color accurate photography of the artwork, but please be mindful that calibrations often vary between devices. If color calibrations are of concern, I recommend viewing the item from multiple devices (desktop, iPhone, etc.)

Shipping Policy

The processing times of each item can be found within the product descriptions. I do my best to ship your orders as soon as possible. I personally package and ship original artworks, stickers, limited edition prints/ products, and hand embellished prints/ products. Open edition prints/ products are packaged and shipped by the drop shipping companies I use. Please note that on occasion, delays in dispatching orders may occur if artwork is going viral on social media. I apologise in advance for any inconvenience and thank you greatly for your patience.

If you need a change of address, I must be alerted within 12 hours or less of purchase in order to do a possible redirect. I am unable to change the address once it has dispatched from my studio or drop shipping company’s facility. Please contact me through the contact page as soon as possible. 

Briana Fitzpatrick is not responsible for undelivered packages based on incorrect shipping addresses given by the customer. Please ensure that you provide the complete and correct mailing addresses at the checkout. If you desire a refund in this scenario, a restocking fee of 20% will be applied and the cost of shipping will be recovered by the studio.

Duties and taxes

The studio is operated in the USA and is not liable for import fees on any products purchased. This includes but is not limited to the commissioning of a custom piece, originals and fine art merchandise.

Any applicable taxes and duties are not included in the checkout total. These are determined by the customs agency in the destination country. Some countries charge import taxes while others do not. The customs agency will notify the recipient either by mail, phone, or email to pay these charges, so that the shipment can continue to its destination. 

It is the responsibility of the customer to pay any duties, value added tax or other similar charges. If you refuse to pay these additional amounts, your delivery will be returned to me. Provided that the product is in its original condition, I will refund you the cost of your purchase (minus the costs of shipping to your country).

Items are declared at purchase value for exporting and under no circumstance will documents be falsified at your request.
